Data often doesn’t receive as much attention as conventional media, software and technology applications. Increasingly emerging technologies, machine learning and AI rely on data to drive efficiencies. However, this often cuts across existing proprietary rights, including rights in data and confidential information. Having robust data governance, coupled with an effective data strategy, is essential.

We have developed a specific, dedicated, cross-practice, interdisciplinary and holistic ‘Data as an Asset’ service offering. This is designed to protect, unlock, enable and maximise value from your data assets – any issues arising from licensing in, and commercialising, others’ data. This combines our experience as regulatory data lawyers with complimentary fully integrated skills from our competition, commercial, technology, intellectual property and tax teams.
Securing your data (and digital) assets is a serious business which is reflected by the importance both stakeholders, rightsholders and regulators place on the value of data. For instance, fines in certain jurisdictions can now be as much as up to 5-10% of a group’s global annual turnover for serious breaches of legislation such as: data protection, cybersecurity, open data (eg EU Data Act and Data Governance Act), competition, consumer and AI regulation. Sanctions of this kind not only influence damage to reputation and trust, but may also result in material decreases in investment, exit multiples, goodwill and share price. Agentic and traditional AI can magnify these risks, as can the ability to re-identify individuals and confidential information through large language models (LLMs) and quantum computing.
