The Subsidy Control Bill is expected to take effect this year (2022). It will form the backbone of the UK’s new subsidy control regime, replacing the prior EU State aid rules. The new domestic subsidy control regime is intended to be “a clear, proportionate and transparent set of principles, underpinned by guidance, that will ensure public authorities fully understand their legal obligations and embed strong value for money and competition principles”.

Whilst the new regime appears to offer the scope for significant new flexibilities in the way in which subsidies are granted, many commentators have raised questions over the transparency and efficacy of the new regime. In this on-demand session, Alex Kynoch and Angelica Hymers explore the practicalities of complying with the new Subsidy Control Bill, and the impact of illustrative guidance and policy statements recently published by the Government. They were joined by Jonathan Sayer, Principal Regeneration Manager of Derby City Council who provided an authority’s perspective on the application of the principles.
